| Description: | Education should be savoured by children with disabilities (CwDs) since education is the source of individual progress leading to the success of a nation. Physical, mental limitations are not the reason for regular schools not to accept their existence. Inclusive education is a form of education that provide hope for CwDs to enrol in school without any impediments and discrimination. Indonesia has implemented it with the goal of respecting, protecting, and fulfilling CwDs educational rights, but hurdles occur frequently. What are the impediments to implement inclusive education for CwDs? Do the law has reflected the fulfilment of social justice for their education? This study attempts to analyse in depth the issue of fulfilling the right to inclusive education from human rights perspective. To analyse these questions, qualitative study was conducted using a socio-legal approach at D. I. Yogyakarta, Central Kalimantan, and Lampung provinces as a case study. Field results assist in evaluating the availability, accessibility, acceptability, and adaptability on the fulfilment of the rights to education based on human rights. The four features aid to analyse the law enforcement of inclusive education. The legal substance of inclusive education has been well met by the Indonesian government, although regulations should be synchronised with one another. The legal structure, however, is weak due to the limitation of human rights understanding on the part of law enforcement officers and lack of the local government knowledge. These weaknesses effected the legal culture because society does not participate in inclusive way. The strengthening, synchronisation of policy, regulation, and societal culture will produce a better design for the fulfilment on CwDs rights thus the implementation can be carried out through the social change. Law as an agent of social change is the strategy in understanding disability model approach to support rights to inclusive education for CwDs.,Ph.D. |
