Description: | Prostitution being one of the oldest vices, violates human sexual and moral norms throughout human history until today. The practice of providing sexual services to another person in return for payment is a kind of trade and may occur with consent or forced situation. Most countries in the world regard this as a crime, and victimisation of women and young girls while others legalize it as a profesion to allow women to enhance their economic gain and opportunity. The Constitution of the Islamic Republic of Iran requires that all laws and regulations should be based on Islamic principles (Sharia'), the main sources are the Qur'an and the Sunna'; the secondary sources includes Ijma (consensus bycompetent religious representatives) and Aql (Reasoning or wisdom) and Ijtihad that produces the fatwa as a means of adapting to the changing needs of society. These Islamic sources are applied and enforced for purpose of protection and prevention of prostitution practices among Iranian women. The significant of the research is that this thesis give a rare account of women protection and prevention of prostitution in an Islamic State such as Islamic Republic of Iran. This thesis objectives are to dwell on the meaning and understanding about women prostitution and Iranian criminal laws, the causes of their involvement and victimisation, the effectiveness of Iranian policies, prevention and rehabilitation laws, and practices as well as the International laws acceptance and measures that could curb prostitution activities in Iran.The scope of the thesis focuses on the issues of women prostitution, the policies and laws, its prevention mechanism and rehabilitation of women prostitutes in Iran. The methodology used in this study is qualitative social- legal case study on women prostitution in Islamic Republic of Iran. The main sources for data collection were from library materials and fieldwork via interviews conducted on women prostitutes in Iran. Data were analysed and categoried to give meanings and understanding on the women prostitution issues and the legal enforcement efforts by the Iranian Government to prevent the spreading of prostitution among Iranian women. The findings of the thesis are; (a) It is significant to differentiate the consented prostitution and forced prostitution; (b) The main cause of Iranian women prostitution is poverty; (c) Peer influences attracts women to prostitution involvement; (d) Women choice to prostitutes are subjected to many factors; (e)There are no specific laws on prostitution in Iran; and (f) Iran need to referrs to international laws and practices as long as they were not in conflicting with the Islamic Laws principles.; (g) The government are making crucial efforts to curb prostitution and rehabilitate the prostitutes. In conclusion, prostitution is not easily curbed and it needs a serious efforts and specific mechanisme to deal with it. The sources of the problem have to be eradicated to achieve a resolution that is satisfactory aftermath.,Ph.D. |
