Description: | In meeting Islam as a just and moderate religion, non-Muslims existing in the Islamic soils are granted their rights of worship and ritual practices they believe in, especially in their shrines in return of their commitment to disciplines and requisites of the zimmah contract. Today, problems and uproars in the Muslim countries stemming from the non-Muslims are attributed to their persistence in contradicting the disciplines of the churches and shrines in the zimmah contract. Besides, there are law and rules stipulated on granting the freedom of worship at the expense of the Islamic rulings. All of this leads to disputes taking place between the religious groups in Iraq and Malaysia. This matter necessitates a true study in order to get to the better solutions. This study intends to explain the legality of existence of the churches and shrines and interrogate the rulings of the faiths in dealing with the laws and rules nationally and internationally, delve into the rulings related to the churches and shrines in Iraq and Malaysia in the light of the present reality, analyse positive and negative phenomena, and examine the better ways of overcoming the problems. This study relies on the approach deducing the evidences concerning the topic, analysing the opinions of the past and contemporary ulama, comparing them and explaining the most established, In addition to using the interview methodology, this study arrives to the fact of the Islamic rulings are concerned about the principles and foundations of morality, humanity and faith, especially in dealing with the non-Muslims. There are various opinions of the past and contemporary ulama related to the building of the churches and shrines according to how the country was opened, the basis of the churches and shrines construction and the comprehension of the rulings argument. Likewise, this study points to the persistence of the churches and shines members on contravening the disciplines. And there are external agendas with negative impact coming from the churches and shrines. This study contributes to the attempt of solving the problems on the topic of the churches and shrines in Iraq and Malaysia in the legal and social perspectives.,Certification of Master's/Doctoral Thesis" is not available |
