The government of Malaysia plans to develop stem cell researches in the country.Ministry of Health and Malaysian Medical Council have made numerous valuable efforts in regulating the stem cell researches and therapies in Malaysia through publishing a number of guidelines. These regulations are established mainly due to ethical concerns which have been raised globally in respect to human embryonic stem cell researches. The objective of this study is to present a critical analysis of Malaysian legal framework related to human embryonic stem cell researches. The major ethical concerns associated with conducting human embryonic stem cell researches are elaborated in this study. The issues include the status of embryo, informed consent of donors, commercialization of hESC researches, and creation of human and non-humans. Among them, the status of embryo is significantly important in this field of study since conducting hESC researches involve destruction of embryos and may raise ethical concern among public and different religions in the society. Furthermore, due to crucial role of religion particularly Islam in making laws on bioethical issues in Malaysia, it is important to find out how sufficient Malaysian guidelines address the religious values in the Malaysian multi-faith society. Hence, the views of existing religions in Malaysia analysed in this study in order to find out the permissibility of human embryonic stem cell researches in their perspectives. Based on the findings of this thesis, all mentioned ethical concerns in respect to hESC researches have been included in the guidelines of Ministry of Health and Medical Council. Moreover, the issues have carefully established in line with Islamic teachings and relevant international standards and guidelines. However, there are a number of shortcomings that could be added to respective guidelines and are not inconsistent with Islamic beliefs or international standards in field of hESC researches. Hence, a number of recommendations are made in order to improve and elucidate the important issues that the respective guidelines lack.,Master / Sarjana
