dc.descriptionDewasa ini munculnya bentuk jenayah baru akibat dari kecanggihan teknologi. Keganasan siber merupakan jenayah yang berasaskan jenayah siber. Jenayah ini telah muncul sebagai bentuk jenayah yang kompleks dalam abad ini. Ia membenarkan pengganas siber untuk mencetuskan keadaan yang bahaya kepada pelbagai negara. Oleh yang demikian, bagi menyelesaikan isu keganasan siber ini, organisasi antarabangsa telah diwujudkan. Walau bagaimanapun, institusi ini memerlukan kerjasama yang komprehensif daripada negara-negara dan juga organisasi yang terlibat. Tujuan tesis ini adalah untuk melihat isu berkaitan keganasan siber yang melibatkan mekanisma undang-undang antarabangsa dan domestik. Penemuan tesis ini mendapati bahawa persetujuan atau persefahaman bersama merupakan keperluan terdesak bagi menghadapi masalah keganasan siber ini melalui penggubalan undang-undang yang seragam. Semua negara perlu berkongsi maklumat dalam menjejaki pengganas dan menjatuhkan hukum terhadap mereka. Hakikatnya setiap negara sangat ingin melaksanakan undang-undang mereka sendiri, walau bagaimanapun ianya tidak sesuai memandangkan masalah ini boleh diselesaikan dengan lebih baik melalui kerjasama semua negara. Oleh kerana sifat internet dan keganasan siber melampaui sempadan, bidangkuasa 'universal' adalah yang paling sesuai bagi mengatasi isu ini. Mempunyai peruntukan undang-undang yang sama atau seragam dan menjalinkan hubungan 'bilateral' dan 'multilateral' antara negara akan membolehkan maklumbalas yang efisien dalam mendakwa pengganas siber. Begitu juga dengan triti berkaitan ekstradisi yang membolehkan pendakwaan dilaksanakan di negara yang terlibat dengan berkesan.,Advancing technology has spawned new types of crime. Traditional crimes have migrated to the internet. Cyber terrorism is a new kind of crime distinct from cybercrime and has emerged as one of the most complex phenomenon of this century that poses a significant threat to nations. Various international organizations have been established and a more comprehensive consensus among countries and organizations is needed to address the issue of cyber terrorism. This thesis investigates cyber terrorism from the aspect of international and domestic legal mechanisms. It seeks to establish a comprehensive definition of cyber terrorism and examines the various antiterrorism legislations and measures taken by nations to protect themselves including measures taken to prosecute cyber criminals. Employing qualitative methodology, this study uses both analytical and case studies to compare illegal and legal usage of cyber space in the discussed countries. Data were analyzed via analytic methods to discover casual factors that affects outcome. The findings show that there is an urgent need for a global consensus to counter cyber terrorism by harmonizing their various legislations. States must cooperate to share information in order to apprehend attackers and sentence them. While individual countries are keen to implement their own laws to handle the problem, a better approach would be to framework a consensus among the international community. Owing to the trans-border nature of the internet and the reality of cyber terrorism, universal jurisdiction is the most suitable option to deter cyber terrorism. The existence of mutual legal assistance mechanisms, extradition treaties as well as bilateral and multilateral arrangements among countries will allow for a more effective response especially in prosecuting cyber terrorists.,PhD-
