dc.descriptionThe current legal framework for employment dismissal adjudication is plagued with problems due to judicial review and appeals. In this study, the researcher highlighted the prevalent problems and proposed a new legal framework to remedy them. The researcher has achieved this by reviewing various literatures on this area and further supplemented by interviews with experts to get reliable feedback and recommendations on the proposed new legal framework. A study into the England legal framework for employment dismissal adjudication was also conducted. For this study, the researcher has referred to the relevant statutes, industrial law cases, textbooks, journal articles, law reviews, press reports and sources from the internet. The researcher discovered that prevalent problems such as lengthy delays, high legal costs and abuse of court processes have compromised the objective of the Industrial Relations Act 1967 which is to settle all employment dismissal disputes fairly and expeditiously. Many industrial law experts have concurred that the current legal framework for employment dismissal adjudication needs to be reformed. The researcher hopes that the findings of this thesis and the proposal of a new legal framework for employment dismissal adjudication in Malaysia will reduce the prevalent problems at hand and thus restore the objective of the Industrial Relations Act 1967 which is to settle all employment dismissal disputes fairly and expeditiously.,Master of Law
