Description: | Penubuhan Bahagian Sokongan Keluarga (BSK) oleh Jabatan Kehakiman Syariah Malaysia (JKSM) dilihat sebagai langkah awal ke arah tindakan yang lebih tegas dalam menangani isu penguatkuasaan dan pelaksanaan perintah nafkah di Mahkamah Syariah. Kajian ini bertujuan untuk meneliti apakah prinsip-prinsip yang menjadi asas kepada penubuhan BSK dan melihat sejauhmana pelaksanaan dan keberkesanannya dalam menangani isu tuntutan nafkah isteri dan anak. Kajian ini merupakan kajian kualitatif yang dilaksanakan menggunakan dua kaedah iaitu kaedah analisis dokumen dan kaedah temu bual. Analisis dokumen dilakukan ke atas sumber-sumber rujukan kitab-kitab fiqh yang muktabar dan sumber peruntukan undang-undang yang signifikan serta fail-fail kes BSK yang didapati di beberapa cawangan antaranya di Wilayah Persekutuan Kuala Lumpur dan Negeri Sembilan. Pendekatan temu bual pula dilakukan menggunakan soalan tidak berstruktur. Temubual dilakukan ke atas tokoh-tokoh yang terlibat di peringkat awal penubuhan BSK, ahli Jawatankuasa Kerja BSK dan pegawai BSK. Hasil kajian ini mendapati penubuhan BSK adalah mengikut acuannya yang tersendiri, berasaskan kepada prinsip keadilan Syariah meskipun terdapat rujukan yang telah dibuat di beberapa buah agensi luar negeri seperti Child Support Agency (CSA) di Australia dan United Kingdom serta Local Child Support Agency (LCSA) di California, Amerika Syarikat selain di Mesir yang menubuhkan Bank Nasr al-Ijtimaci. Di dapati juga model BSK pada hari ini merupakan 'hybrid' atau gabungan peranan di antara Mahkamah Syariah dan BSK sebagai agensi penguatkuasaan dan pelaksanaan perintah Mahkamah Syariah. Selain itu dapatan kajian juga menunjukkan beberapa aspek penting perlu dibuat penambahbaikan, iaitu keperluan mewujudkan undang-undang atau kaedah sebagai mekanisma yang mengawal aktiviti BSK, kedudukan Peguam Syarie BSK yang perlu diasingkan dari Mahkamah Syariah dan meningkatkan tahap pengurusan dana BSK secara lebih berkesan termasuk idea yang boleh dibincangkan secara kritis iaitu penubuhan yayasan keluarga Islam. Ketiga-tiga aspek tersebut didapati boleh memberi impak yang baik kepada BSK jika dibuat penambahbaikan melalui penggubalan undang-undang, pengasingan institusi BSK dan kerjasama yang baik di antara JKSM, Mahkamah Syariah Negeri-negeri, Majlis Agama Islam negeri-negeri dan Jabatan Peguam Negara Malaysia.,The establishment of the Family Support Division (BSK) by the Shariah Judiciary Department of Malaysia is an indication towards seriousness in enforcement and implementation of maintenance at the Shariah Court. This research aims to analyze the founding principles of the existence of the Family Support Division, its enforcement and effectiveness in overcoming issues of petition of maintenance by wives and children. This research is a qualitative research. It used both document analysis and interview methods. The data gathered from document such as authentic jurisprudence books, significant related legal provisions and cases obtained from several BSK branches such as Federal Territory and the Negeri Sembilan state. Interview with those involved in the early stage of the establishment of the Family Support Division, its committee members and officers were conducted using unstructured questions. The research finding shows that the division follows its own organizational structure, based on the principal of Islamic justice. However, reference is also made to several foreign agencies such as the Child Support Agency (CSA) in Australia and United Kingdom and Local Child Support Agency (LCSA) in California, United States of America and the Bank of Nasr al-Ijtima'i in Egypt. The present model of the BSK can be described as a hybrid model, for it combines both function and role of the Shariah Court and the BSK, as an agency tasked with the implementation of the Shariah Courts' orders. The findings of the study also highlight the need for organizational improvement of the division from several aspects, such as provisions of specific administrative rules and regulations, separation between the BSK and Shariah Courts' lawyers, upgrading financial management of the BSK for its effectiveness. The idea of establishing an Islamic family foundation should also be considered. These changes in three aspects of the division could contribute positively to the improvement of the BSK provided such improvement has been made through enactment of laws, separation of BSK institution and co-operation of BSK with JKSM, Shariah Court states, Islamic Religious Council and Attorney General's Chambers of Malaysia.,Master/Sarjana |
