Description:	Terrorism became an important concern both nationally and internationally after the 9/11 terrorist attacks. The increased terrorist activities in the past two decades have become a grave threat to international peace and security. It compelled States to adopt effective counter-terrorism measures to combat this menace. Several States including the United States have taken special measures to tackle this problem. Unfortunately, Pakistan has failed to introduce proper enforceable measures. Although various laws have been passed and penalties have become stricter in Pakistan, the lack of proper enforcement has made them ineffective. Moreover, weaknesses in the criminal justice system of Pakistan have made these efforts unproductive. The absence of a precise definition of terrorism also hinders the process of successful counter-terrorism measures. The research discusses following questions: What is the existing criminal legal framework for terrorism in Pakistan? What are the weaknesses in the current criminal justice system that holds back its effectiveness to prosecute terrorists? What are the international laws on counter-terrorism and the legal obligations of Pakistan under such laws? This research is a doctrinal qualitative and comparative legal research that recognises the importance of locating the research within particular social, cultural, legal and historical context under the light of relevant statutes of criminal law and procedural codes used in the criminal justice system in Pakistan. It also examines weaknesses in the justice system to prosecute terrorists and problem related to the definition of terrorism. The methodology adopted for this research will be interpretive, evaluative and analytical. The research demonstrates that the lack of proper infrastructure and the implementation of laws are basic hurdles behind the success of counter-terrorism measures in Pakistan. Moreover, gaps in the investigation process, collection of evidences, the safety of eyewitnesses, judges and prosecutors and an uncertain definition of terrorism make Pakistan's criminal justice system unproductive to prosecute terrorists successfully. The study concludes by providing suggestions to solve the problem of defining terrorism and enhance the legal and judicial system of Pakistan.,Ph.D.
