Description: | Environmental forensics relates to environmental investigations encompassing procedures and methods of evidence collection. The data generated from forensic investigation, such as chemical analysis, and physical findings facilitates strengthened reporting to enable the prosecution of environmental crimes. Environmental forensics approach is now widely used by enforcement agencies in developed nations worldwide. This research explored questions pertaining to the practice of environmental forensics in Malaysia; the organization responsible, required measures for enforcement, as well as the prerequisites to the application of the environmental forensics approach. Focus was given on identifying and determining the structure and process related to the policy, roles, mandate and mechanism for overall environmental management organization which relate to the implementation of an environmental forensics system. The mixed-methods approach was adopted, combining quantitative and qualitative research design. An initial study was undertaken, and interviews from selected respondents from industry and environmentally related government departments were conducted to identify levels of understanding of environmental forensics and determine the appropriate government department to be given responsibility. Based on the the analysis using the Cronbach‘s Alpha technique, results show that the Department of Environment Malaysia was the primary choice to take on the responsibility. Content analysis was also carried out to review the organisational aspects, legislations and policies related with environmental forensics based on three selected countries; Australia, United Kingdom and United States, and the same was carried out for Malaysia. The Environmental Quality Act 1974 and the Environmental Quality (Scheduled Wastes) Regulations 2005 revealed that the environmental forensics is not explicitly mentioned but the elements are embedded in most of the provisions related to the environmental investigation. At the same time, specific cases associated with hazardous waste management including contaminated site, illegal dumping, import and export of hazardous waste, and also the related legislation were also analysed. Finding shows that there isn‘t an integrated approach to the application of environmental forensics in Malaysia, and it is still in the early stages. The analysis also showed the need for the adoption of Standard Operating Procedures and Plan of Actions related to environmental forensics. Based on the findings it is proposed that the application of Environmental Control System (E-KAS) and Electronic Scheduled Waste Information System (eSWIS) be expanded to include the environmental forensics approach.
