dc.description | The Minangkabau ethnic has their own customs and tradition as a legal system to rule the family and marriage. Even though they have their own principle "Customs and traditions based on legislation and legislation based on Holy Quran", but the reality is some of their custom and tradition is not parallel with sharia and its relation to al-CĀdah Muhakkamah (Customary Taken as Legal). This study invistigates wedding custom and tradition of Minangkabau ethnic based on al-CĀdah Muhakkamah method, as difrences of views appear between the wedding customs and traditions of minangkabau ethnic and the Islamic rule "Al- addah Muhakkamah". This study aims at finding out the meagures of the application of al-CĀdah Muhakkamah in view of the customry in marrige system and matrilineal kinship.This study also analyzes the difference in views between Islamic view of al-CĀdah Muhakkamah and tradititions and customs related to marrriage, husband and wife relation, children, and inheritance based on matrilineal concept. Besides that, this study also reviews the view of Islamic Contemporary scholars on the issues of Minangkabau wedding custom and tradition. This study is qualitative and based on content and survey analysis by collecting data from primary and secondary sources. Interview method is also conducted to support the research. The result of this study shows that al-CĀdah al-Muhakkamah method is not only to adduce to be Shari'a law, but it also meant to develop a Shari'a law and applay it whenever needed. It is also found to be in line with latest Fuqaha views which says that custom and tradition might be used as long as they are not in conflict with shari'a law. This study also shows that the old custom and tradition implemented by Minangkabau etnic has been changed as it became more based on shari'a law. This fact is situated upon the phelosophy of Minangkabau etnic that "custom and tradition is based on shari'a and shari'a is based on Qora'n".
