| Description: | Legal provisions relating to conversion to Islam in Malaysia have been improved over time, especially after the leading case of Natrah in 1942. The Natrah’s case had enlightened many concerned parties towards the need of having a proper law related to conversion to Islam. Although the law relating to the procedure to convert to Islam has been regulated, until now, however, there is no specific provisions mentioning on the need for the muallaf to publicly notify their non-Muslim family members about the conversion. It is an absolute discretion of the muallaf either to inform or not to inform after the conversion. The absence of any regulations concerning the notification aspect is said to be one of the factors that creates difficulties to the muallaf in handling their conversion matters, as well as to the religious authorities. This has led to a bigger issue including the jurisdiction conflict between the Civil and the Syariah Courts. These issues are claimed to be originated from the action of the muallaf who failed to disclose their conversion to the non-Muslim family members due to the absence of any law imposing such action. This study has concentrated on the theoretical part of the concept of privacy in Islam by looking at the views of Muslim scholars from several schools of thought in order to answer whether is there a need for the converts to declare their conversion to their family members. This research also evaluate the rights of the muallaf and possible implications if they openly declare their conversion, and the possibility of having a specific law to govern this matter. This study employs a case study using content analysis where data are analysed using descriptive approach. The study finds that scholars of classical and contemporary do not engage into detail about this matter and leave this issue to the muallaf. However, this study also finds that there are several problems faced by the muallaf when they inform the family over their conversion. It seems the existing law failed to offer any solution to this matter. It is therefore, that proper regulations to be designed and drafted in Malaysia in order to deal with conversion issue relating notification to the non-Muslims family members.
