| Description: | The emergence of cyber bullying cases in Malaysia can be seen through the cases reported to Cyber Security Malaysia. Since 1998, 11 cyber bullying cases was reported to Cyber Security Malaysia and since then it has started to increase and reached the highest number recorded so far was in 2017 with the total number of 560 reported cases. Though the number decreased in 2018 with 356 reported cases and 260 cases reported in 2019 but the scenario is at an alarming rate. Due to the uncertainty of application of law pertaining to the cyber bullying in Malaysia, this research is meant to identify and analyse the relevant criminal provisions in Malaysia with regards to the same. The research is confined to cyber bullying in the form of harassment from three leading Social Networking Sites, MySpace, Facebook and Twitter. The objectives of this research is to identify the law and cases in Malaysia pertaining to cyber bullying. The descriptive method was used to explain the applicable local provision (s) in protecting victim against cyber bullying and aggression in Malaysia while the analytical method was applied to examine and analyse the law and cases in United Kingdom and United States. Through the analysis of law and relevant case law pertaining to cyber bullying in United States, United Kingdom and Malaysia, the researcher had identified few comparative legal issues of cyber bullying. The findings revealed that the existing relevant cyber bullying criminal provisions in Malaysia are inadequate to solve the problems in cyber bullying. Based on these legal issues and findings, recommendations had been addressed for future guidance and betterment of law.,Master of Laws |
