Description: The Uniform Domain-Name Dispute-Resolution Policy (UDRP) provides a mechanism for resolving disputes between domain name owners and trademark holders who claim that a domain name infringes their trademark. One of the debatable issues under UDRP is precedence. The UDRP does not offer specific precedent rule in its proceeding but the majority of the panels refer to previous decisions in their decision.Thesis is divided into three main parts. First, the legal analysis of paragraph 4(a) and rule of precedent in resolving domain name disputes. Second, it evaluates the paragraph 4(c) of UDRP and examines the related cases and precedence. Thirdly the thesis will examine the role of precedence rule in UDRP and it present statistical analyses of the 500 cases in UDRP from 2001 to 2011. Also this thesis examines the effect of legal education and nationality of panels in precedence.,Master / Sarjana
