dc.description | When talking about globalisation, foreign direct investment (FDI) becomes one of the most argumentative topics. Investment agreement makes countries to have international relationship that cause different issues like conflict of laws and difficulties due to arious cultures and business behaviours. China had a huge growth in the economy due to the increasing number of FDI since the late 1970s. As foreign investment increases, the number of disputes increases as well. One of the most challenging issues involved in investment agreements is dispute settlement procedure. There are different methods of dispute resolution in China which Chinese tend to those that have 'amicable consultation'. China is known as a country of ceremonies and cultural etiquette. The first thing that should be considered is the cultural differences between Chinese and other societies and investors should be careful while having investment agreements in China in order to have a successful business relationship and make it continue and develop. Parties of a business relationship may face difficulties and risks due to cultural differences that understanding the best method of dispute settlement can reduce them. In this research the role of culture on the election of dispute resolution will be studied and the focus is investment contracts as they have increased in the history of china in the last decades. It is the characteristic of investment contracts that involve different parties from various cultures which can make differences in their business attitude specifically in choosing dispute resolution methods. The methodology used is content analysis which is qualitative and based on library work. The research analyses the factors that can be a reason for Chinese to prefer amicable resolution methods. This study is limited to gathering previous knowledge and reports of business experts. It is advised for future studies to go through quantitative research based on having questionnaire and interviews from Chinese companies which have faced cultural conflicts in order to find a more accurate and explicit conclusion.,Apabila berbicara tentang globalisasi, pelaburan langsung asing (FDI) merupakan satu tajuk yang sering diperdebatkan. Perjanjian pelaburan menjadikan negara-negara saling menjalinkan hubungan antarabangsa antara satu sama lain. Ini menyebabkan pelbagai isu timbul antaranya kesukaran dan konflik undang-undang disebabkan oleh kepelbagaian budaya dan tabiat perniagaan. China memiliki kepesatan perkembangan ekonomi disebabkan oleh peningkatan bilangan/jumlah FDI pada lewat tahun 1970-an. Peningkatan pelaburan asing telah menyebabkan peningkatan perbalahan. Salah satu isu hangat yang sering terlibat di dalam perjanjian-perjanjian pelaburan adalah prosedur penyelesaian masalah. Terdapat pelbagai cara untuk menyelesaikan masalah di China yang mana, orang-orang China lebih cenderung kepada penyelesaian bersama seperti meditasi, konsilasi dan arbitrasi berbanding litigasi. Perkara pertama yang patut dipertimbangkan adalah perbezaan budaya antara orang-orang China dengan masyarakat barat dan pelabur-pelabur haruslah berhati-hati semasa melakukan perjanjian pelaburan supaya mereka memperolehi kejayaan di dalam hubungan perniagaan seterusnya memperkembangan perniagaan mereka. China dikenali sebagai sebuah Negara penuh adat istiadat dan berbudaya sopan. Adalah menjadi suatu kepentingan bagi mana-mana institusi atau organisasi yang berkehendak untuk menjalani perniagaan memahami nilai-nilai bangsa cina yang berbudaya dan beretika dan pada masa yang sama nilai-nilai perniagaan yang pesat berkembang. Dalam tesis ini, kesan-kesan budaya dalam seleksi resolusi pertikaian akan mengkaji dan memfokuskan kepada kontrak-kontrak pelaburan memandangkan ianya telah mengalami perkembangan di dalam sejarah China sejak berabad. Ianya adalah karateristik kontrak-kontrak pelaburan yang melibatkan pihak-pihak yang berlainan dari pelbagai budaya yang mampu membuat perbezaan di dalam perilaku perniagaan mereka terutamanya di dalam memilih method-method resolusi pertikaian. Kaedah yang digunakan ialah analisis kandungan yang berkualiti dan berdasarkan kerja perpustakaan. Kajian ini adalah terhad untuk mengumpul pengetahuan dan laporan pakar-pakar perniagaan sebelumnya. Ia adalah dinasihatkan untuk kajian masa depan melalui penyelidikan kuantitatif berdasarkan mempunyai soal selidik dan temu bual daripada syarikat-syarikat Cina yang telah menghadapi konflik budaya untuk mencari kesimpulan yang lebih tepat dan jelas.,Bachelor | |
