dc.descriptionBai'al-inah merujuk kepada kontrak jual dan beli balik. Ianya merujuk kepada konsep jualan barang dengan harga bertambah secara bertangguh bagi tujuan menjualkanya kepada penjual pertama secara tunai dengan harga yang lebih murah. Tujuannya adalah membantu peminjam memperolehi wang tunai dan pemberi pinjam beroleh keuntungan bukan dengan kaedah pinjaman riba. Di Malaysia, pada masa ini kontrak bai'al-inah di terima pakai dalam produk perbankan Islam apabila ia dianggap sebagai satu langkah untuk menjadikan produk dan instrumen kewangan Islam lebih mudah untuk bersaing dengan produk perbankan konvensional. Walau bagaimanpun amalan pengaplikasian bai'al-inah tidak diterima oleh ulamak kontemporari terutama ulamak dari Timur Tengah. Pandangan ini mengambil hukum yang diambil oleh majoriti ulamak feqah yang terdiri daripada Mazhab Maliki, Hanbali dan Hanafi yang melarang pemakaian kontrak bai'al-inah dalam urusan muamalat. Dasar pengharaman mereka adalah kerana bai'al-inah mewujudkan risiko kepada riba. Penentangan ini memberi kesan yang hebat kepada institusi perbankan Islam di Malaysia yang banyak mengaplikasikan kontrak bai'al-inah dalam produk dan instrumen kewangan mereka. Kajian ini dilakukan secara kualitatif dengan menggunakan kaedah pengumpulan data berdasarkan kajian perpustakaan dan internet. Objektif kajian ini bertujuan untuk mengkaji pengaplikasian kontrak bai'al-inah dalam produk pembiayaan peribadi secara Islam dan mengkaji isu-isu perundangan yang terdapat didalamnya. Hasil kajian mendapati bahawa dari segi praktikalnya pengaplikasian kontrak bai'al-inah dalam produk pembiayaan peribadi telah mengalami perkembangan yang pesat. Walaubagaimanapun kajian mendapati terdapat perselisihan pendapat di antara ulamak tentang penerimaan bai'alinah. Majoriti ulamak menentang penggunaannya kerana ia dikatakan sebagai hilah kepada riba. Sebaliknya, kajian juga mendapati wujud juga hujah dan pendapat ulamak yang mengharuskannya atas dasar keharusan berjual beli secara am dan juga atas sebab menjaga maslahah. Seterusnya penilaian dibuat bagi mengenalpasti isu-isu dan masalah perundangan yang timbul daripada pengaplikasian kontrak bai'al-inah dalam pembiayaan peribadi Islam. Kajian mendapati bahawa pemakaian kontrak bai'al-inah perlu diperhalusi bagi memastikan syarat-syarat kesahihannya dapat dijaga. Kajian juga mencadangkan agar kontrak bai'al-inah digantikan dengan satu kontrak syariah yang disepakati penerimaannya di kalangan ulamak seperti kontrak murabahah dan ijarah.,Bai'al-inah technically means sales of buy back. It refers to the trading concept whereby the seller sells his assets to the buyer at an agreed selling price to be paid by the buyer at a later date. After that the buyer immediately sells back the assets to the seller at a cash price, lower than the agreed selling price. The reason behind this kind of sale is to give cash money to the debtor while guarantee profits to the creditor without getting involved in riba based transaction. Nowadays, bai'al-inah contract is recognized in Islamic banking product as a measure to develop Islamic financial product more competitive as against the conventional banking product. However, bai'al-inah is not accepted by contemporary jurist particularly scholars from the Middle East. This views were stimulated by the views of the majority of classical jurists including the Malikis, Hanbalis and Hanafis which prohibit the application of bai'al-inah in Islamic transaction. They argued that bai'al-inah is a legal trick that open “back door” to riba.The declination gave great impact on Islamic banking and finance industries in Malaysia in which most of the products are using bai'al-inah contract as the underlying contract. This study applied qualitative method by data collections which were based on library and internet research. The objective of the study is to study the application of bai'al-inah contract in Islamic personal financing product and its legal issues and problems. The finding of the study shows that Islamic personal finacing using bai'al-inah contract as the underlying contract has experienced rapid growth. However there are differences of opinion among the scholars on the legality of bai'alinah. The majority of the jurists view that such a sale is forbidden as it leads to riba. However the minority of the jurists permit this sale on the basis of the generality of the permissibility of the sale and for the beneficial interest of the society (Maslahah). In addition, the study also analyzed the issues and legal problems arising from the application of bai'al-inah contract in Islamic personal financing product. In conclusion, the application of bai'al-inah contract in Islamic personal financing product needs to be refined to ensure its validity condition is observed according to the shariah requirements. It is recommended that bai'al-inah contract be replaced by shariah contracts that are acceptable by the majority jurist like the contract of murabahah and ijarah.,Sarjana Muda
